World is now fear of instability again whereby peace become the concern although in this
21st century. Technological advanced era does not guarantee peace. Besides, the
advancement of technology leads to a greater risk towards instability. The perspectives of
disputes become wider. The sources of disputes are increasing. States do not only struggle
in claiming territory but also apprehended by the new challenges due to the
modernization as example globalization. Globalization makes things and processes
become revolutionized and transformed into a complexity. Things and processes are
becoming more difficult to be settled. Disputes happen because of new foundations.
States are not only in conflict with other states, but also with groups of people within the
state; their own people. There are various means to settle disputes. Peaceful means are
always the first choice rather than going to war. Mediation is one of the ways to settle
disputes. This study will analyse critically the mediation as a process to find solution
between two conflicting parties as well as examining the mediator as the third party in the
peace process. It will not be called mediation if there is no third party facilitator to assist
in the process of finding ways to settle conflict between the Government of Philippines
and the group of people called MILF. This case study was chosen because it involved
Malaysia as the mediator to intervene in the peace process. Besides, the Mindanao peace
process has shown smooth progress towards building peace in the territory again.
